In preparation for the upcoming Supreme Court case to decide the constitutionality of Arizona’s SB 1070, anti-immigrant group Federation for American Immigration Reform (FAIR) released a short report summarizing the arguments from both sides. Several provisions of the contentious law are being challenged by the DOJ, including the measure that allows law enforcement to to verify a person’s immigration status on “reasonable suspicion” that he or she is undocumented. Arizona contends that SB 1070 accords with federal immigration law. FAIR and other anti-immigrant groups have awaited the SCOTUS decision to determine the federal government’s receptiveness to state-level nativist legislation.
